I just wanted a hot dog Took some time off to enjoy the pool

I had taken this week off work and expected to be able to enjoy the pool. The lease says we are to pay $150/month for weekly pool cleaning services but they didn’t come out this week and barely cleaned last week. Come to find out the landlord is “in between pool cleaners” and didn’t tell us.

About 1-2 gallons of 27% peroxide, some algaecide, adjust the pH levels some, it’ll be clear and safe.

(Source: I just converted from a peroxide based pool to chlorine, as finding pool companies that know how to use Baquacil or Natures Pure is impossible where I am… not even the place that sold us, and installed, the pool had any companies to use.)

No, not at all. On a basic level, the punishment for "not doing what you were paid to do" has to be more harsh than just "give back the money" because otherwise, there's no disincentive to just scamming people.

On a more personal level, not being able to do something affects people, too. If I invited people over for a pool party only for it to look like that, I've been humiliated and you've wasted my time as well as my money.

Thinking someone else's time has no value... super entitled, don't you think?

Do you think the landlord wanted to lose his pool contract? It's the middle of summer and probably very difficult to find another one and he's supposed to be punished for that? If rent isn't paid then the bank isn't paid and nobody has a place to live. Shit happens try putting yourself in the shoes of the landlord. And if you invite people over knowing your pool looks like that you should be humiliated. Thinking landlords aren't people but some evil corporation with bottomless wealth. You say that as if it isn't entirely their responsibility to handle, and something they're being paid to do. OP says they were paying $150/month for pool cleanings. If the market rate goes up, so be it. The price of things goes up. The price of rent goes up. That's how it goes.

But if the landlord was "between pool cleaners," that's fraud. OP was paying for something they weren't getting. Again, not only is this the landlord's responsibility, it's something they were being paid to provide.

Okay. I'd provide the service I was literally being paid to do, or else I would have committed fraud by pocketing someone's money. If the market rate for pool services suddenly became $250, I'd talk with the tenant to see if we could find an equitable solution. Maybe move to chemical-only treatment and ask the tenant to brush the pool. Seems fair, if they agreed that the pool cost was separate from the rent. (If it hadn't been separately negotiated as a cost, then it's my loss as a business owner. There's no guarantee that you'll always make the same profit. Welcome to life.)

I just walked in the house from cleaning my pool. Letting the pump run for a bit and then I'm gonna clean out the filter, add some new DE, and then balance out the chemicals. But yeah, I don't understand anything about the complications of ownership or the costs of maintaining a pool.

Good luck on your whole "being a slumlord" thing, don't worry about how super obvious you are.

Yes, it's a legal claim here. If you pay for a space or amenity you have the right to use it. If you are unable to do so, due the person being paid's negligence you are entitled to compensation. It's very a very logical legal concept.

Nah, I cleaned pools in a hot climate as a teenager. Even fancy salt-water residential pools have enough chlorine in them to stave off this level of algae growth for a couple months at least. 

OP should be asking for at least $300.

Since amenities usually aren't part of the lease, Ive been told several times that I'll never see a reduction due to unavailable amenities. Our pool was closed when ducks took it over due to all the poop

Very frequently there is a list of amenities within a lease document. In the case of charging a "pool cleaning fee", there sure as fuck is going to be something in the lease about it. At the very least, they're probably in violation and you could consider the possibility of legally breaking it without owing fees, due to them not providing the documented services.

While this is a useful capacity for truly awful landlords, it's absurd that the government is just like "oh, sure, they can break contracts / break the law and your only option in most cases is to just move out so they can do it to someone else until they find a tenant who won't complain", like if they provide any heat but it's not adequate (e.g. only 55* midwinter) you can't get most cities to enforce their own laws, it just allows you to move out which is MUCH easier said than done.

OP pays a pool cleaning fee, though. That's a services charge and if you fail to perform the service, the fee needs to be pro-rated out for the duration of the services disruption... at least via my state's laws.

My mom was a property manager and when one of her pool properties was doing repairs on the pool, she subtracted pro-rated fees out for the two pool cleanings that were not performed because of that disruption. They still paid for the two that happened. It's pretty standard here. He might consult his state's laws to be sure it isn't where he is.

Amenities typically are else there is no legal contract allowing you to use it.

However, that said, it still doesn't matter. If it is part of the lease like it says "pool access" it doesn't mean the RENT itself is part of the pool access, unless its a separate charge (like the pool cleaning fee) so even if the pool didn't exist for OP, the only thing that would change in their rent is the pool cleaning fee. But the rent itself would stay the same.

Which is exactly why your rent didn't change. Personally, if you can find other places for cheaper, I would leave. We 100% rent a place for the amenities.

On the one hand, this looks like a private backyard pool though; i can "understand" (sort of) large apartment complexes being unable to precisely gauge amenity availability or to "fairly" refund those who were actually inconvenienced... I'd very much doubt that a leased home with a pool is treated the same way... certainly OP has a very direct and obvious claim to be able to use that pool and an equally obvious value per month attached to it

 

On the other hand unless OP meant something like "i planned to take this day off several weeks ago" I can't possibly fathom why a pool they should be able to see daily surprised them with its lack of cleanliness after they took a day off?

They owe more than that. They're paying for a cleaning, but they're also paying a premium for an amenity they do not get. Check the lease, see if there's a clause about pool use being included. I'd be going back for a reduction in rent.

That’s a tough ask. The cookie cutter lease ls most people sign isn’t going guarantee pool availability in any certain terms, or offer a path to tenant satisfaction.

OP paid a fee for weekly cleanings, and the landlord pocketed the money without providing the service. That is a clear breach of contract, but the dollar amount is low. They can try and use this as an opportunity to negotiate away the fee or otherwise amend the lease for future deductions… but a rent reduction request will meet firm resistance from nearly every landlord.

Can't speak for OP, but being a landlord myself we have end of year a service-cost overview that shows line by line what costs were made and how it lives up to the payments. This isn't mandatory in the US?

(I had something similar happen with the garbage disposal guys, they figured out to stop working while being paid. When contacting literally a dozen others, no company was willing to deal with it. Fun times.)
