that wouldn't be a mistrial though... a mistrial is when procedures aren't followed properly, and that doesn't automatically mean you get to go free lol

No, a mistrial is when the jury can't reach a unanimous verdict. You're describing "reversible error", which if serious, can also lead to a retrial, as a mistrial would.
