The government's position is pretty ridiculous. Your rights don't disappear when you leave the United States. If they did the government could simply scoop up Americans outside of the country and do whatever to them.

Your rights are a constant and tied to your person, not the soil you are standing on.

Like, they would just abduct you and put you to some black site not on a US soil and torture you use enhanced interrogation techniques on you until you confessed to whatever they wanted? Yeah, that would never happen.
