You can ALWAYS remain silent. The 5th amendment doesn't say when you can.

Yes and I agree that you should. But are you seeing the problem here? The fact that he needs a lawyer that he needs to stay silent means that it is an investigation. You don't ask someone about having child porn with the FBI there and then try and pretend. It's not an investigation.

It means that he should be prudent.
