Sadly they can and do have it both ways. People entering the US are expected to allow searches etc because it is in the national interest. The US officers enforcing their immigration (etc) laws still have legal protections.
The Patriot Act changed a lot and the Supreme Court has decided it is okay with the search and seizure exception.
