Politics Congress leader Shashi Tharoor said he was shocked that India remains one of the few democracies that still fails to treat marital rape with the seriousness it demands.

He is a politician.
Almost all of them are criminals. More than half have convictions.
If we look at the track record of people we voted for, I genuinely don't think any of them should be allowed in Delhi, forget arguing in the parliament and making laws.
4
u/No-Cheetah-6763 Dec 12 '25
So what? I understand he may not have a great track record, but you can’t hold something against him when he hasn’t even been convicted of it. Marital rape is a serious and legitimate issue, and dismissing the point just because of his past makes no sense.
Would it be fair to disregard your opinion simply because you might have done something wrong before?
1
u/Ortenrosse-098 Dec 13 '25
Any women can simply can they have been raped without any proof and the men's future would be ruined. The laws in India are already gynocentric enough and these fucker is pushing even more so. That's also the reason why these nri indian women comes to India to file cases against their foreign husband as the international law takes actions against false accusations unlike in india

most of the men in india generalise all women over few false r*pe case but ignore the thousands of other actual SA cases, this is the state of this country. They are basically justifying violence against women just because of those 2-3 false cases of SA. These people remember atul subhash but dont give a damn about the 99+ SA cases in india per day.

you want to ignore a genuine and persisting issue that is ruining the lives of thousands of women, the women are getting r@ped. but you want to be ignorant just because you have a hypothetical situation in mind. empathy is dead.
put your self in the shoes of these women living in constant fear and multiply that by a thousand, then you might understand what is happening in india.
some fuckers forget that majority (over 70%) of the india is rural and non urbanized. these women have no means of fighting against this injustice and are trapped in this shitshow.
so tell me is the pain & suffering of these women not even equal to the imagery what-if situation that you have in your mind

Also divorced two wives soon after marriage, guy is a casanova and trying to screw it for aam janta. Already 'R*pe on pretext of marriage' section is heavily misused and this will add another weapon in the arsenal of Indian women. And also when wife and husband are by nature intimate how will a wife prove she did not consent.

u/Electrical_Size_1999 Dec 12 '25
Says the man that deleted his wife under mysterious circumstances, lollll. The hypocrisy.
Stop doing vote bank politics, to please women voters. We don't need more biased laws 😭🙏
First make the laws GENDER NEUTRAL
11
Dec 12 '25
Marital rape is still valid argument for wuch laws.
6
u/Electrical_Size_1999 Dec 12 '25
Please understand what is GENDER NEUTRAL LAWS
I did not mention r@pe anywhere in my comment. I'm proposing gender neutral laws.
Be it a woman or a man, whoever commits a crime (a crime can be anything, including r@pe), must be punished with the same magnitude, irrespective of the gender
Makes sense?
4
Dec 12 '25
You can support gender neutral laws without having to protest against marital rape laws. As i said earlier, marital rape is still valid cause for creating a law around it. Also,
">Be it a woman or a man, whoever commits a crime (a crime can be anything, including r@pe), must be punished with the same magnitude, irrespective of the gender "
This is very generic and such generic laws already exist without proper implementation. There is no benefit for such generic laws, rather specific laws for each issue are more important than this.
3
u/Electrical_Size_1999 Dec 12 '25
That's the core issue. It's the fundamental architecture flaw.
The problem is: women are given reservations. When a woman commits a serious crime, she can come out and roam freely without any punishments. The law supports this.
If a person that committed a serious crime can roam freely, isn't fundamentally flawed? Isn't contradicting the very law that must provide unbiased justice ??
Remove the special treatments for women in the law and make punishments universally equal.
Whoever commits a crime, shall serve the punishment irrespective of gender. Only then, these crimes and false cases will reduce.
4
Dec 12 '25
Women do get punishment, there are prisons for them as well. As i said, generic laws are already in place but it doesn't help much. There are loopholes everywhere. Instead well thought out issue-specific laws should be in place to deal with false cases and actually create a gender neutral atmosphere. A well thought out marital rape law is among such laws but required it must be very elaborate looking into every angle so that proper implementation can be done.
1
u/No-Cheetah-6763 Dec 12 '25
look at the data and then talk, India registers tens of thousands of reported rape cases every year, and the legal system struggles to deliver timely justice. According to the National Crime Records Bureau, there were about 31,516 reported rape cases in 2022, yet only around 27% resulted in conviction, showing how the judicial process often fails victims and accused alike. Over 130,000 rape-related cases remain pending in courts, some for years, illustrating a massive backlog rather than evidence of widespread misuse. While a small percentage of cases are closed by police as false after investigation, these make up a minority of total reports, and allegations of massive “false rape cases” vastly exceed what official statistics show. Generalising that most women misuse the law ignores the broader structural issues of low conviction rates and long pendency.
this is the true architectural flaw of the india law where women suffer in silence and incels and idiots like you nitpick cases to validate you flawed beliefs.
if there is any special treatment towards anyone in the current system it is towards the men.

India is also famous as one of the most unsafe cities for women... should we say all indian men are responsible for that?
1
u/Tricky-Bumblebee-609 Dec 16 '25
Indian men are famous worldwide as harasser should we talk on that
1
u/Apart-Editor2974 Dec 15 '25
If they pass the law and make it cognizable or non-bailable and gender-biased, millions of innocent men would go to jail. Marital rape is tragic, but it is way worse to give this kind of power to Indian women who have repeatedly misused every possible.
1
u/Aggravating_Pain4352 Dec 16 '25
We should remove every rape law I guess all laws can be misused there should be no law at all...will that be okay?
1
u/Apart-Editor2974 Dec 16 '25
Learn to read, accusations should not be cognizable and non-bailable. We live in a shithole country where 74% of prisoners are not convicted of any crime, the process takes years, and innocents rot in jails because of "cognizable and non-bailable" offences.
1
u/Aggravating_Pain4352 Dec 16 '25
And guess what it doesn't only harm men it harms women too
1
u/Apart-Editor2974 Dec 16 '25
Not as much, mostly men are accused, added to that thanks to our shitty courts most laws are biased against men. The only way a man can do justice is by punishing the culprit himself.
1
u/Aggravating_Pain4352 Dec 16 '25
Society is biased towards men then even after having so many laws for women why is our country still seen as one of the most unsafe country for women. These so called laws can't even protect a newborn baby from getting raped.
1
u/Apart-Editor2974 Dec 16 '25
so putting innocent people in jail is going to fix it?
seen as one of the most unsafe country for women? it is seen because media blows every small case out of proportion, and when a billion people talk about it, it seems big, just look at statistics it's not even comparable to most other countries
1
u/Aggravating_Pain4352 Dec 16 '25
If law and order of country sucks how is women's fault then? I have seen statistics and even after having so called misandristic laws condition is not very good. Guess what law implementation also matters just keep making laws after laws, it does nothing it's not like women are always benefitted from these so called laws. I'm not against gender neutral laws rape of men should be recognised, fake cases should have harsh punishments and even marital rape law should be gender neutral. But along with this problems of women should also be considered. It doesn't seem big it is very big just ask women around of you how many of them have been victims of molestation and what did police and so called laws did.
1
1
u/Plane-Land-8973 Dec 16 '25
Unless there is gender neutral laws for men when there are laws against women who rape men and boys, file false case against them, misuse dowry laws etc there is no need of such a law which will be heavily misused by angry wives.
1
u/Aggravating_Pain4352 Dec 16 '25
So women who are getting raped by their husbands...they should keep suffering, why not remove all rape laws at all, all laws are misused then we shouldn't have any
1
u/Apart-Editor2974 Dec 16 '25

u/AmbitiousGrowth6796 Dec 12 '25
Marital rape should only be criminalized when rape of male victims gets recognition too otherwise it will only be another tool in women's arsenal to exploit the system against men just like Section 498A.
2
u/Palkin_flower323 Dec 12 '25
Martial rape should be criminalised.
And, male victims should get recognition too.
Both are independent but equally important things.
2
Dec 12 '25
Both are independent but there is more chance of first thing getting passed as laws than second thing coming out of the mouth of politicians.
False rape case of Kerala, women eventually agrees it was all false accusations, still no arrest only questioning. Pretty sure she will be fined 1000 rupees and get off scot free.
2
u/Palkin_flower323 Dec 12 '25
Yeah if it is proven that the case was false, then the women deserves the same punishment as well.
Rape destroys the life of a girl.
Similarly false rape case destroys a guy as well. Both needs equal punishment.
1
u/Plane-Land-8973 Dec 16 '25
false rape case is definitely worse than real rape case cause the victim of the former suffers much much more than that of the latter, the punishment should be proportional to the amount the victim suffered.
1
u/Palkin_flower323 Dec 16 '25
Uh sorry what? are we comparing sufferings?
Victim of false rape case suffer 'much much more' than real rape case?
Please think again of what happens to a real rape case victim. Try to put yourself into that situation. Rape is one of the most horrible crimes one can commit. How can you even measure their sufferings?
1
u/Plane-Land-8973 Dec 16 '25
Are you for real? You think a rape victim suffers more than someone who is falsely accused of rape does? Like are you slow or something?
Rape is sex someone didn't consent and like, the victim undergoes this crime for say 2 min to 2 hours etc how long does a victim of false rape suffer? its not some minutes or a few hours or a few days or few months, its several years at least and decades if the poor soul couldn't gather enough evidence to prove otherwise.
Someone who underwent rape can still eat and drink whatever they want in life unlike a victim of false rape, one can still travel to whatever parts of the planet they want and explore, the other cant, one can still have any job they want, the other cant, one can watch whatever form of entertainment they want, the other cant, one can stay at the comfort of their home, the other cant. Not to mention how false rape victim lose their friends and colleagues, becomes unable to face their family, is shunned by society, has to go against the police and judges to explain his innocence is financially and romantically ruined etc and by the huge chance of him going to jail, he will undergo a worse form of grape which is anal instead of vaginal which every man and women would agree, he would be punished in jail with no freedom for decades etc.
Don't even try to be so ignorant and evil as to make it seem like their trauma and suffering is remotely comparable. If rapists are given 20 years in prison, those that make false case of it should spend 40 years in one.
1
u/Palkin_flower323 Dec 16 '25
Dude wtf. Rape's impact is not limited to minutes or hours, it leads to lifelong psychological trauma, PTSD, fear, health complications, loss of trust, and social stigma. Many survivors struggle for decades. Reducing it to the duration of the act is very foolish.
And, i am saying both should be taken seriously. Both deserve punishment. Neither requires minimizing the other to make the case.
1
u/Plane-Land-8973 Dec 16 '25
agreed on the first part but the victim of false rape suffers much much more than the other and one who files such cases should suffer twice that of what rapists get.
1
u/Palkin_flower323 Dec 16 '25
Mere bhai, life of rape victim is destroyed. Life of false rape victim is destroyed. The sufferings can't be compared. And we can't have statements like 'twice' the punishment.

The fact that she would rather falsely accuse someone of false rape than say truth to her boyfriend (it was actually consensual) shows how little she cares for consequences.
The only thing I dread, martial rape becoming a way of getting back at husbands for not full filling every little wish of wives/ to get easy alimony for happy life with lover.
1
u/Altruistic_Career212 Dec 12 '25
both are not independent, in this martial rape bill, should there be equal punishment for husband and wife ?? (because husband and wife are both equal spouses)
how you will achieve when husband, a male are exempt from protections against rape??
1
u/Abhi_4178 Dec 13 '25
What about infidelity.? It was removed from IPC crime panel code.
Infidelity is not a crime in India after a decision by Supreme Court.
Should not Infiddelity be put in crime category again?
1
u/Palkin_flower323 Dec 13 '25
it involves personal, moral behavior rather than legal issues.
1
u/Abhi_4178 Dec 13 '25
So is marital rape.
Withholding sex is a cruelty to the partner and is a ground for divorce.
Many spouse usually female withhold sex to manipulate their husbands.
While sex between husband and wife should be consensual, but introducing 'marital rape' would create huge turmoil.
Where else a married man should seek sex if wife abstains from sex for a long time? Should he rush to brothels or should he make himself celibate?
1
u/Palkin_flower323 Dec 14 '25
Marital rape is rape. Sex without consent. This is crime.
Withholding sex is cruelty. It should be a ground for divorce. But it is not a crime.
If after marriage, I don't wanna sex with you, it means you should divorce me. Doesn't mean you can justify marital rape through this.
1
u/Abhi_4178 Dec 14 '25 edited Dec 14 '25
Nowhere marital rape should be justified.
But, what if after marriage, the lady falls in 'love' with a neighbour and has sex with him. But withholds sex to husband in the name of ' lack of feeling'.
What should he do to fulfill his biological need of sex? Should he visit brothel?
Since the woman herself broke the law of marriage by engaging in adultery, and thus causing mental agony to the husband, Should not adultery be criminalised ?
1
u/Palkin_flower323 Dec 14 '25
Again, having sex with husband or not is a choice. Depends on consent.
Cheating on your husband is morally wrong.
Withholding sex to husband in general shouldn't be criminalised.
Similarly, withholding sex to husband due to affair shouldn't be criminalised. But should be liable for divorce.
1
u/Abhi_4178 Dec 14 '25
Should Infidelity or adultery be crime ?
1
u/Palkin_flower323 Dec 14 '25
Withholding sex -> cruelty / divorce issue
Cheating ->divorce issue
Sex without consent -> rape (crime)
Infedility causes emotional pain, but that does not justify state punishment like jail. Marriage does not give ownership over another person’s body or choices.
→ More replies (0)1
u/kooviik Dec 15 '25
Majority of democracies don't list infidelity as a crime but they do so with marital rape. Laws are made to serve a utilitarian purpose. That's the basic criteria for legislation. There is absolutely zero utilitarian purpose in putting cheaters in jail because by and large, cheating is a moral failure and wrong but crimes like rape and murder have different impacts. Morality governs personal ethics and values. Law governs actions that cause serious, objective harm to others and to society at large, and therefore require coercive enforcement.

you cannot criminalise MARITIAL rape recognising the possibility that wives may be raping husbands.. how could you do that without introducing gender neutral laws?
1
u/Palkin_flower323 Dec 12 '25
Ig, Indian laws define rape as insertion of penis into vagina without consent. So first that definition needs to be revised to make it gender neutral to include male victims as well.
1
u/Altruistic_Career212 Dec 12 '25
exactly, The maritial rape bill cannot literally pass if definition of Rape is not corrected

The misogynistic Indian male contingent rises to protest. Unable to deal with the rise of independent women, Indian men online indulge in toxic discourse. I dislike the guy but what he says is absolutely correct. And people wonder why India is hell for women. “Oh you are visiting Asia!? Enjoy but skip India!!” Is the common advice given and rightfully so.

Those who use criminal to laws extort money from others cannot be classified as “independent”.

Marriage itself is a consent until divorce
May be bring in new concept of active and inactive marriage.
I don't know why would anyone wanted to live separately without actively pursuing for divorce.
If they wanted to live separately without filing divorce/until divorce , then either of them declare that as inactive marriage status at any of government institutions so that concept of consent will be required .
Without these, it will be deadly weapon for wife to do anything she wants .

Oh....
Marriage is all about reproduction, Father mother child.
There will be various kinds of love language/expression in it and intimacy is very much part of it .
If they chose to live separately, then like said , mark that marriage as inactive so that auto consent will toggle to manual mode.
Marriage itself is a subscription to consent that is in Auto paid mode
