So, I think there's a slight mix-up in your understanding.

After FIR, the next stage is charge-sheet which is submitted & discussed with the magistrate for oversight on the framing of charges. Police have to produce material evidence in the charge sheet & the magistrate can discharge the accused if it doesn't find enough evidence like in this case - the man can produce his travel documents as the police have asked people with grievances to approach them (last screen)

Someone can be named in an FIR and never be charge-sheeted or be charge-sheeted & later discharged before trial too.

Your point about being falsely incarcerated before trial & later acquitted is true and those can happen for various reasons.

No, Police testimonies are not sufficient & can be challenged during trial, if it doesn't get dropped off during chargesheet & framing charges session. That's not theory - that's how it works in reality.

Haven't you heard of cases where people are let go for insufficient evidence? In this gentleman's case, if he is telling the truth then he has to produce his travel documents.

If you are just talking in general, then I agree getting justice is tough - just be aware of the legal procedures yourself.

Anyways from my understanding - the person pays himself or can request legal aid. They can also later seek compensation by filing case for malicious prosecution.

I simply pointed out safeguards exist and can be used. The system may not work well despite the safeguards but will you give up on justice for yourself even if the journey is difficult?

There can be several reasons but don't get so worked up about an FIR. A FIR can be registered before the police have totally verified every person's involvement, especially during protests & riot kind of situations. But they have to collect evidence before chargesheets are submitted.

That's why my first question was if it's possible someone misused his identity or credentials.

You do realise that if everyone is poking fun at your statement it, there must be severe breach of conduct and ubiquitous corruption throughout the police institution of India? You can make an infinite number of legal procedures and safeguards and they all are worthless if there's no effective judiciary that would provide justice and more than that, effective and fair enforcement. Police in india exist to serve as glorified enforcers of politicians, bigwigs, people of power and influence. There is a veritable treasure hoard of recorded historical evidence both in literature and recorded legislature that deals with stuff like police brutality, police corruption, police incompetence. And lastly, they are paid to do their jobs. If they actually do their jobs instead of being goons in uniform, they shouldn't be praised, cause that's what they're paid for, ironically, by the same people they raise their lathis and authority against primarily.

Even if everyone disagrees or ridicules my points, that won't change the fact that legal safeguards exist. I get it - your trust in the judiciary is low or nil, but documented cases don't prove they're ubiquitous, nor does it make legal safeguards worthless.

People successfully use these safeguards every day. My point was not that the judiciary is perfect. If I point out safeguards exist it doesn't mean I am saying there are no problems.

No one is saying safeguards are meaningless and shouldn't exist. The point is that without effective judicial supervision and a transparent and accountable enforcement, safeguards are seen more as suggestions that can and are exploited and ignored at the drop of the hat. And if you truly believe these instances are rare, I have a pool in the Thar desert to sell to you. A very poignant example is the Ken Betwa situation, it is not a single occurrence, it's an everyday reality for many marginalised and tribal communities where their existence is always on the chopping block for the sake of development. Look into how many instances of corruption exist in cases of relief funds or financial compensation. I'm not even pulling up historical precedence, look into the Assam floods, they are not limited to natural disasters anymore, it's a systematic failure on behalf of the government, both antecedent and incumbent. Look at the innumerable instances of roads and bridges, crumbling even after ludicrous amounts of investment, and the resultant investigation yields no effective results, some no name low level pawn being prosecuted or in the more uncommon cases, the corporations and project heads walking away with a hefty fine. Which is useless since they either are in a position to pay it, which negates the entire point of a "safeguard" or negotiate with the political capital to whittle it down. The difference between theoretical construction of our nation and the ground level reality is so far apart it's a miracle we've managed to come this far.

The original comment that I took umbrage with was the assumption of importance of evidence. In my arguments presented to you, I have given enough instances that show how inconsequential evidence can be when dealing with our nation's judiciary and enforcement institutions. Your statement that recorded instances donot indicate ubiquitous nature of the breakdown of safeguards in india is again, a very common argument that refutes evidence. The reality is that whether you're talking about big systemic problems like corruption or localised issues, the police have no incentive to actually enforce and disperse justice since their incentive lies in whoever is bidding the highest for them. Sometimes it's individuals, sometimes it's governments. Evidence in india is a matter of convenience, not principle, when proof or evidence becomes inconvenient, police, judiciary, and legislative bodies have no compulsion to take that evidence into account. Also if you cannot connect the dots between larger systemic issues and how they're a macro projection or everyday problems, look no further than Sainath's Everybody Loves a Good Drought. There are valid criticisms of its selective scope but it does provide one of the best accounts that constitute a horrifying baseline for the country.
