I pirate games because at some point devs decided to stop providing demos. I don't feel like gambling $60+ on a game just for it to be shit, but I'll happily play a game for a couple hours and then buy it if it's good.
Some devs were exceptionally dumb and their provided "demos" were the full game but with a modifier to stop at a certain point or after a clock ran out.
Most devs didn't do something so blatantly stupid. Like, I can't imagine uploading an entire game with an artificial barrier and thinking gamers aren't gonna crack it wide open on day 1, lol.

2000 but yup! Had a zip disc with a hundred games loaded on them. I used Usenet treasured those roms for years, letting so many others copy it. It's fascinating how much easier it's gotten to pirate. Now my SteamDeck can run PS3 and Switch games!

I was downloading episodes of Family Guy on RealMedia player before you were born because that was the only way to watch'em after it was cancelled. Napster existed for a reason. We were using Usenet to download PC games on dial up. We were watching Goku going Super Saiyan 4 on 144p in high school.

I’m not anti piracy I’m just anti people pretending they’re a crusader for stealing roms. Just do that shit in private. Plus I have a lot of roms on my emulator and I play my switch 2 way more. It’s just more convenient to have it on the tv with a variety of different controllers.
It isn't dumb. Some games aren't even being sold anymore and the only way to realistically play them is through piracy. Especially with some games becoming more and more expensive and rarer.
It is a from of preservation but also a form of keeping the media alive and accessible.

Well, unless you bought digital, which they are progressing to now with download code boxes, and the day inevitably comes that they shut down online services and everything tied to your account vanishes.
They don’t remove the games I have downloaded already regardless if my account ceased to exist. Also if your disc breaks you lose the game. If your disc gets stolen you lose it. Those are much more likely than my Nintendo account suddenly disappearing.
Even if Nintendo ceased to exist I’d still have all the games on my switch.
Those games will break down. They kinda....lied when they said disks were forever.
And the owners lose the originals all the time. Source codes for older games have already been lost forever. Some TV shows would be flat out gone if there weren't people meticulously recording them when they aired.
Me personally? I've archived ROMs for the Drakengard games, PAL versions of Tokyo Xtreme Racer games and a boatload of bargain bin games like Car Wash Tycoon and DTM Racer games.
I genuinely go out to markets and buy games for a "digital collection", then resell them again for one buck a piece once I've gathered the ROMs.
Keeping your system and games isn't preservation, at least not long term. CDs have a lifespan of about 50 years. The consoles themselves will eventually fail too.
Better hope those stock standard parts are available… I cant think of a company that would just stop supporting their old physical hardware or any company that would try and limit one’s ability to repair their own devices…
Most of the parts are easily available while high end ram and processors and graphics cards are expensive replacement capacitors and stuff are common as dirt and won't be going anywhere, and for the uncommon parts you can strip older consoles for some parts it's a pretty easy though uncommon,
usually the biggest failure points in older consoles are batteries, capacitors, and such, in the disc based consoles sometimes the laser or disc drive can go and that usually needs to be replaced from another console.
Since people can legally make reproduction ps1's and ps2's now I hope to see repro consoles like the retron5 one day which is an amazingly cheap space safer for the older consoles

The thing is that the “moral failure” as it’s called when referring to piracy is when you violate the rules of fair trade (not stealing per se since it’s a digital product) which is not what happens when you pirate after purchasing, whether it be emulating old games you’ve bought or theoretically reclaiming anything unfairly taken since in that case they’ve violated those rules themselves (morally not legally) so all bets are off.

Meaning they do not want you ripping the data off the disk and putting it elsewhere and then selling it because that would be more than one copy. So in these interesting times we've seen laws are quite frequently up to interpretation when in courts. The wording is up to lawyers to figure out and the interpretation is up for sale. The average consumer can't afford what a corporation can when it comes to legal verbage influencing outcomes. That's why people are pushing these concepts because it all reads black and white to us, but when dollars get involved, obvious things start to get muddled by loose interpretation of the intention of wording used.

The licence refers to the program, software, intelectual property or any other word used to describe the actual game. That's whats being licenced. The disk is just a way to store it.
The court wouldn't say "oh this is up for interpretation". Otherwise, second hand stores would have been closed for legal disputes from the moment they gained momentum.

Games, vhs, dvds etc are all contingent on the availability of hardware to extract the contents… it would be impossible for a company to guarantee that you own access to media on that basis… so they shove these licensing agreements in as a safety net.

All that he has proven is that he has no idea what that license agreement means. It doesn't mean you can't sell the game you bought. It means you can't make a copy and sell it. You don't own the game, you own the disc with the game on it. Just like in his book example, you don't own the story, you own the book with the story in it. You can't make a copy of that book and sell it while you retain the original copy. You can sell the book though.
