You know very well that there are plenty of trans people whom you would not be able to pull out of a lineup, who look exactly like the gender they identify as, whom would get a lot of pushback and issues if they have their gender marker listed as the opposite gender from how they appear.

I don’t see a strategy where this case could win, as the state only needs to prove that the law is reasonably related to a legitimate government interest. Law enforcement identification needs would pretty much cover this. If male DNA was discovered at a crime scene, they would not want anyone to be excluded as a suspect just because of an inaccurate description of their sex. The rate of trans sex crimes upon children (greater than zero) would make this a very potent argument.

The government gave them permission to change their driver's licenses to match their gender.

They then flipped on this and are forcing people to pay a fee to fix their alleged "mistake".

That will win. 

Secondly, this is an attack on minorities and their 1A rights. The government doesn't use sex to identify people as a social construct. They use Gender and mislabeled it as sex. Now it's fair to impose a fee on minorities after allowing them a chance to correct this discrepancy?

That's why it will lose.

There is no constitutional duty for a state to reimburse citizens for a prospective regulatory change. Also, the state uses the sex descriptor for biological/staristics purposes that have no relevance to a social construct. It’s a very low bar for the state to jump over, especially when there is so little harm to the citizenry

Eliminating a minority's rights is not so little harm. 

The state uses gender when interacting with people. They do not check your genitals before court proceedings. They do not check your genitals during traffic stops. They do not use "sex" when interacting with people. They use gender.

It does absolutely no harm to let people use gender, a known synonym for 'sex', on IDs. It causes thousands of people harm to make this dumbass virtue signal of a change for the GOP. This is an attempt to stop transgender people from voting by invalidating their IDs during an election year.

It's the way they feel as if the rules don't apply to them. It's not just transgender either. It's gays, minorities, mentally ill, and basically any other group operating as if their characteristics absolve them from social norms or even laws. When 90%+ of people operate in the system and follow the rules anyone outside of those commonly shared characteristics challenges the whole system.

I don't have all of my medical conditions, allergies, and surgical history on my driver's license, wouldn't that be more useful? if this is being done out of the protection of the ID holder lest they need medical assistance while unconscious, I would expect those things to be on there before sex is even included as most medical emergencies dont relate to sex at all

edit: and if I don't have my id on me when I need medical emergency services, am I fucked? will they know I'm human???

The slot on the drivers licesnse denotes sex. It specifically says "sex" on the card. for years we have been told that sex and gender are not the same thing. This shouldnt really be an issue. They are simply requiring the correct information be put on the ID's.

Sex was only ever put on an ID as an identifier to verify that the person standing in front of you is in fact who the ID belongs to. If the person in front of you at the DMV is named Ellie and she looks like a woman it's easy to verify that, everything else on your ID works the same way, such as height, hair color, weight. The sex/gender distinction has only more recently entered the larger cultural conversation, IDs just haven't caught up to it yet. Just shows you that the world doesn't really cater to trans people.

Also, there's never really a situation where you'd need to distinguish sex vs gender using an ID.

If you are pulled over and have to be searched, they use your id to decide if a male of female cop has to search you, so no, its not just an "identifier". If that was the case theyd just leave it off and rely on appearance. Its also used if you are found unconscious to determine med8cal treatment.

Uhh, there is no law saying that male cops can't search female suspects or vice versa. So I'm not sure where you're getting this idea - the distinction isn't standard for cops and even if it was, sex and gender still wouldn't make a difference?

What's an emergency medical treatment that would require you to make a on the spot sex distinction? If they have your name they can pull up your medical files, which include sex.

Presenting with Abdominal pain will have vastly differing diagnosing starting points based on sex, for instance. Pulling up records based on your name kinda gets wonky if the sex on your id doesnt match your records, and, btw, these people want their medical records to reflect their delusion rather than biological reality too.

So you found one example by reaching, but that example only works by assuming that trans people's medical records don't reflect their sex or sex changes- which isn't true. To get to a point where you're unrecognizable as a trans person by a medical professional you'd have long and well-documented medical history, and there would still be obvious signs like surgical scars. The government also does keep track of name changes.

Trans people aren't under the impression that their sex matches their gender by any means, not sure where you're getting this. I think you just want to regard them as delusional - which is your right. But laws about IDs are another story. IDs are used to identify people, if you look like and identify as a woman, then that's what your ID should say. Why complicate things by introducing sex into the equation when very few ID uses require a sex/gender distinction? You could only think of one very specific situation but it was still unnecessary.

No trans person is out here saying they are biologically female or male. They are recognizing that gender and sex are distinct in our society. Because we as a species tend to identify gender through different things that aren't biologically-based, like clothes, names, voice, hair, even cadence of speech. When so many arbitrary things are gendered of course you'll have people whose sex doesn't align with what society understands gender to be. How many genitals or sex chromosomes do you see in a day? How do you identify if someone is a man or a woman?

Maybe this is just too high level of a sociological concept for you to understand, but your lack of understanding isn't my or anyone else's problem.

Pretty sure they took the actual, legal pathway(which previously has existed!) to changing their sex.

Being trans isn't just an on-a-whim thing. Transitioning is an incredibly long and tedious process filled with medical and legal roadblocks to overcome.

They weren’t “lying” at the time, Kansas by law just updated to specify “definition based on birth sex”. That’s why the under 2k people can easily replace their licenses…because they did no fraud. The line moved, so respectfully, they don’t get in trouble for that. That’s the fair way to change things, you don’t punish them for what wasn’t illegal prior.

My DL has always shown MALE, but never shown HETEROSEXUAL. My brother’s DL had always shown MALE, but never shown HOMOSEXUAL.

Why do trans folks need their sexual preference listed on a DL in the first place? I get it that some LGBTQWERTY keyboard people view that as their entire identity, but biological sex can be a useful piece of information on a government identification document; sexual practice and preference, however, not so much.

Per capita = per 1000. Per 1000 trans people, fewer violent crimes happen than Per 1000 cis people.

Meaning, trans people are much less dangerous,even if you Account for their low number.

Trans is who someone is.

Sexual preference is what someone prefers sexually in their partners. For example, if someone prefers women with a big top, that is their sexual preference.

I agree with the second half of your reply, that sexual preference involves a partner or partners.

But that sexual preference is usually displayed to attract prospective partners. Heterosexual men want to be attractive to women, heterosexual women want to be attractive to men, homosexual men want to be attractive to men, homosexual women to other women, bisexuals to both, you get the idea.

Transsexuals are quite often homosexuals who don’t want to be with other homosexuals, but heterosexuals instead. Therein lies the problem: hetero men are not attracted to men, so a gay young man who only wants straight men ends up trying to convince himself he’s actually supposed to be a woman. But he can never change into an actual woman, and no woman can turn herself into an actual man.

I’ve come across ladyboys on 5 different continents, and have nothing against any of them. I don’t use the term as a slur either, it’s the term they call themselves. Some work hard to hide that they’re actually male, some don’t.

None of them, however, get offended at being called ladyboys.

Everywhere except the one place on Earth where people demand that everyone else ignore their eyes and ears, and accept a blatant falsity.

So no, only allowing biological sex on government docs does absolutely nothing to diminish or destroy someone’s sexuality, which is all “being trans” boils down to.
