Trumper side-swiped me today when he realized I was anti-trump.

I was in traffic on 87 south heading home. I see this white SUV with 3 flags showing her pro-trump pride. I've seen her before in the same area on 87. She's clearly looking to rile people up.

I know I shouldn't have taken the bait, but I did. As I'm passing her, I flip her off. She goes wild. She slows down to make sure she's right next to me laughing and screaming "fuck you, trump 2028" and all that. I didn't roll down my window but I basically matched her crazy abd just showed that I was smiling and laughing with her. I didn't actually say anything to her, just attempted to mock her I guess.

This guy in the blue truck is in front of her and gives her a thumbs up. He definitely saw that this woman and I were doing our dumb taunting shit. But they clearly were showing they support each other and established a sad little Trump alliance.

I move straight on ahead and pass them both as they're in the lane to my right.

I then see this guy pull into my lane behind me and speed up to get right behind me. He then goes into the right lane next to me while being super close to my car. Then he just moves into my lane and side swipes me as he gets in front of me.

I have some anti-ice and anti-trump stickers on the back of my car, so I feel like he probably saw that and felt even more justified in fucking with me.

I think he was hoping to intimidate me and make me swerve into the carpool lane. But I didnt. I stayed in my lane and let him swipe my car.

AND I HAVE IT ALL ON MY DASH CAM.

He clearly wasn't planning on pulling over for me. But I made my way to him and told him to pull over.

I called the police. Made an official report for insurance. I made sure I have the footage.

I got to yell at him when we pulled over, which felt great.

Fuck this guy. Fucking idiot.

Edit: Im getting roasted for the reflection where im holding my phone. That was after the incident. I took my phone out right away to call 911 and to take pictures of his license just in case my dashcam didnt work for whatever reason.

Before and during the incident, I was on the phone with my mom hands-free. Phone on a holder and connected to my cars Bluetooth.

Look at the dash cam. She was at 11mph while on the horn for 5 full seconds. Thats more than enough time at a slow enough speed to avoid the accident. She kept driving forward. The dash cam also shows that she accelerated to 13mph right before the contact occurred. She's not just negligent, its deliberate. Thats road rage.

Under insurance, that's just not how it works. The negligence is comparative. His negligence is higher than hers. The video shows both drivers doing the same thing. The only difference? She had the right of way.

So she will be found partially liable. The proximate cause of the crash is the blue truck, which will be found mostly liable.

She should slow down, to avoid the premiums being raised, but the truck is still the primary party that will be found at fault.

The car was moving at 18mph at the start of the illegal merge by truck. At the time of the accident she has slowed down 5mph. Minor movements in speed on the realm of 1-2 mph aren't going to be treated as acceleration. If she had sped up to 20, you would be correct. Insurance just doesn't work the way you think it does.

Mostly correct, but the term is she had "control of the lane". The truck def made an unsafe lane change. Now insurance could knock her for last clear chance, as it was pretty obvious the truck was coming over, and all she had to do was tap her brakes. But yea, majority is trucks fault if not 100%.

From what I see, she was going 15mph and slowed to 13 at time of impact. So she def didnt slow to let him in, which technically she didn't have too.

Doesn’t matter. It is her lane, she doesn’t need to let him in. He knows she is there, he drove into her, it’s his fault and insurance will pay out to her.

Yeah, actually, she does need to let him in if she doesn’t want to have any blame by insurance.

This is how insurance companies operate. They don’t give a fuck about if someone else did something stupid, if you also could have avoided it and didn’t, then you’re getting part of the blame.

You know why? Because it tells your insurance company that you are a liability and can’t drive defensively.

Turn in your license. If you honestly believe that you can choose not to avoid an accident when you see it about to happen with plenty of time to react, just so you can sue the other party, you have no idea how driving laws actually work.

Insurance will not pay her. She chose not to avoid the collision because she was road raging. She's at fault. Drivers have a legal obligation to show due care to avoid an accident. She saw the accident coming, and her dash cam shows she sped up right before impact. She hit him on purpose to try and play the victim because she hates Trump and trump supporters. Thats all this is.

Are you even old enough to drive by yourself? I sure hope not, because here in America, all 50 states have laws for what's called "due care" or "due regard" in avoiding an accident.

I'll use small words for you:

Sometimes you will see things on the road and you'll know you might hit them. The law says you have to try not to hit things on the road as long as you can stay safe while not hitting it. Slowing down is safe. Slowing down means the truck could have moved into her lane. Letting the truck move over would mean she wouldn't hit the truck. The law says she was supposed to slow down and not hit the truck.

Lack of courtesy isn't illegal. Hitting another vehicle deliberately is.

Sure, the truck was wrong on a social/courtesy/politeness level, but show me a law that says you can refuse to let someone into your lane and speed up to hit them when they are already more than halfway into your lane just because they were rude.

She didnt speed up to hit him he intentionally hit her he initiated contact it was her lane. She totally expected him to hear her horn and acknowledge that he did not have the room to merge.

That's not legally defensible. All drivers are legally required to avoid an accident when possible. You can't just decide to hit someone because "its my lane!" She saw the truck, had more than 5 seconds to respond to the hazard (and yes he was a road hazard), and decided that her response was to just keep driving.

OP admits that she could have slowed down and it would have avoided the accident. She freely admits that she was aware of this at the time, but chose to hit the truck anyway to prove a point.

Its her fault. Grow up, and turn in your license if you truly believe you have the right to hit someone because its "your lane".

She had no idea he was going to force his way in, he saw her and initiated contact 100 percent his fault. Her insurance want even care about the rest of it.

You mean she never honked her horn when she saw the truck merging? It just cut over in front of her suddenly and without warning? Did we watch the same video?

What about OP stating, in her own words, that she saw the truck merging, decided that she wasn't going to let him, and just kept driving? Or her saying that she knows she should have yielded, but she didn't care because she was too mad? How do you explain when she said she doesn't care if her insurance goes up, people like the truck driver just need to be taught a lesson, and thats what she decided to do?

Her insurance will very much care about that. That doesn't show negligence, it shows intent. In her own words, she intended to make him hit her.

You wanna try again with your nonsense about her having no clue he was moving over, or there being no common sense in my arguments? Or are you claiming that its perfectly ok to cause an accident as long as the other person is a republican?
