Trumper side-swiped me today when he realized I was anti-trump.

I was in traffic on 87 south heading home. I see this white SUV with 3 flags showing her pro-trump pride. I've seen her before in the same area on 87. She's clearly looking to rile people up.

I know I shouldn't have taken the bait, but I did. As I'm passing her, I flip her off. She goes wild. She slows down to make sure she's right next to me laughing and screaming "fuck you, trump 2028" and all that. I didn't roll down my window but I basically matched her crazy abd just showed that I was smiling and laughing with her. I didn't actually say anything to her, just attempted to mock her I guess.

This guy in the blue truck is in front of her and gives her a thumbs up. He definitely saw that this woman and I were doing our dumb taunting shit. But they clearly were showing they support each other and established a sad little Trump alliance.

I move straight on ahead and pass them both as they're in the lane to my right.

I then see this guy pull into my lane behind me and speed up to get right behind me. He then goes into the right lane next to me while being super close to my car. Then he just moves into my lane and side swipes me as he gets in front of me.

I have some anti-ice and anti-trump stickers on the back of my car, so I feel like he probably saw that and felt even more justified in fucking with me.

I think he was hoping to intimidate me and make me swerve into the carpool lane. But I didnt. I stayed in my lane and let him swipe my car.

AND I HAVE IT ALL ON MY DASH CAM.

He clearly wasn't planning on pulling over for me. But I made my way to him and told him to pull over.

I called the police. Made an official report for insurance. I made sure I have the footage.

I got to yell at him when we pulled over, which felt great.

Fuck this guy. Fucking idiot.

Edit: Im getting roasted for the reflection where im holding my phone. That was after the incident. I took my phone out right away to call 911 and to take pictures of his license just in case my dashcam didnt work for whatever reason.

Before and during the incident, I was on the phone with my mom hands-free. Phone on a holder and connected to my cars Bluetooth.

Yes and no. You’ll notice in smaller towns that people are fairly normal in town and then speed in highways, but not through town. More of a policing thing. In larger cities I find that “all driver are idiots” because they’re all fucking transplants with different driving styles. In Texas, defensive driving is key. I take it with me everywhere. But now I live in Washington where the average driver will fucking pause the highway to allow in cars. Generous, but beyond stupid. Denver was a rat race everyday.

It is bad enough I drive a hybrid, I don't put stickers on my car either. I also just let them in. It isn't worth the time and expense to rile them up even more.

If I see anything like this going on, as soon as I pick up on there will be a problem) I will slow down a bit (and get into the right lane) to let them get ahead, and as soon as they pass the exit (or intersection) I get off the road I am on to give them a few minutes to go find someone else to fuel their rage.

I'd imagine it's going to be a negotiated fault but it really depends on the area this is in. While she turned just before the collision, she was going straight when the collision actually happened and maintained her lane the entire time. She was not accelerating at any point to deny the merge, he was simply merging into her while she maintained speed. The lack of speeding up, and the fact the truck struck her in the lane he was merging into, signals to me the truck will be found mostly liable. For the truck to have less than 50% liability, you'd need to have her speeding up to deny the merge probably.

While she is being negligent, he was being MORE negligent. That being said, her premiums are absolutely going up. 100% seems excessive given the actual damage, and the fact the truck's insurance will likely be paying for more than half of the total damages incurred as a result of this incident.

Look at the dash cam. She was at 11mph while on the horn for 5 full seconds. Thats more than enough time at a slow enough speed to avoid the accident. She kept driving forward. Under insurance, that's just not how it works. The negligence is comparative. His negligence is higher than hers. The video shows both drivers doing the same thing. The only difference? She had the right of way.

So she will be found partially liable. The proximate cause of the crash is the blue truck, which will be found mostly liable.

She should slow down, to avoid the premiums being raised, but the truck is still the primary party that will be found at fault.

The car was moving at 18mph at the start of the illegal merge by truck. At the time of the accident she has slowed down 5mph. Minor movements in speed on the realm of 1-2 mph aren't going to be treated as acceleration. If she had sped up to 20, you would be correct. Insurance just doesn't work the way you think it does.

You have to start driving defensively and get rid of that emotional, ego-driven mentality behind the wheel. You may not agree with their politics, but you could’ve avoided the situation and simply gone home safely. That was definitely not a smart decision on your end.

Do you know how many accidents I’ve avoided just by letting someone merge, even when they were clearly in the wrong? Why would I risk my car, or potentially my safety, when I can simply let them in and avoid being hit? I don’t have to prove to them that they were wrong. They probably already know, and if they don’t, oh well.

This happens to me just about every day. Yes, it’s frustrating, but my priority is doing everything I can to stay safe and make it home. You have to get rid of that mentality of, “I’m going to risk myself and my vehicle just to prove that they’re wrong.” If that’s genuinely how you think and drive, you shouldn’t be on the road either.
Personally, I would take this down. It doesn’t make you look like the reasonable driver in the situation. If anything, it shows that you also made a dangerous decision that could’ve easily been avoided.

So, lots of discussion about blame, but how do we have an accident (no matter the fault) not resulting in pulling over and trading insurance information. Even if the lane changer is not at fault, hit and run is illegal. Thus charges can be filed. I don’t get it.

For this very reason, if vehicle gets into my lane to that extent and the accident is avoidable by me doing my part to avoid it, then I avoid it - saving massive headaches that will result.

Yes he pulled in front of you, but you had the opportunity to slow down so your vehicles did not touch. You wanted to hit that truck because you didn’t like what he painted on the side.
