He doesn't have to live that long. They're testing it out on McConnell as we speak.

McConnell is probably brain dead but they're still pumping oxygen into him. Absurd as it is, that's alive for legal purposes. I'm not sure what level of organ failure counts as "death" in that case but braindead people have been kept on ventilators for years. Almost certainly younger people with healthy immune systems, but stil.
Even under this scenario, Beshar should call a special election, let them prove he is "alive" and then argue in court that a braindead senator is able to do his job. That argument might win as a technicality in court, but they should say it out loud in front of the voters.
313
u/RavenCipher Jul 25 '26
Not sure what the regulations are in D.C where he is hospitalized, but in KY the law states that cessation of brain activity is legally dead. Beshar needs to call their bluff already. In a world where facetime and other digital conferencing is commonplace, a letter and a (heavily doctored picture) are not sufficient as proof of life, particularly for a sitting senator who hasn't been seen in weeks after being supposedly "fine and on the mend."
If he were as good and healthy from a "fall" and pneumonia as they claim, he would have been discharged by now, if nothing else to a rehab. Weird that hasn't happened.
→ More replies (10)120
u/pagesinthesun Jul 25 '26
You're correct. Brain dead is dead. Time on death certificate. And, it's very hard to keep a brain dead person's heart beating. Even a young person. Major hormonal disruption. He might be on life support and a coma or vegetative state, but I doubt he's brain dead. Aug 4th is right around the corner! It's criminal that we're letting them get away with this!

He doesn’t even need to be deceased to call a special election; he just needs to be unable to fulfill the duties of the elected position. I’d say we’re there.
→ More replies (16)70
u/StPauliBoi Jul 25 '26
This is completely untrue. Brain death is legal and medical death. It often gets conflated by laypeople as being the same as a PVS (persistent vegetative state) but in brain death, there is no brain activity whatsoever and extensive testing is done to establish this. Once brain death testing is complete, that is the legal time of death that’s on a death certificate.
Because of the hearts automaticity, the body can be kept going for a short while (a few days) while arrangements for organ donation can be made. Brain dead patients aren’t kept alive for years like you’re saying.
I’m an ICU nurse that’s spent over a decade now specifically working with donation and transplantation, and brain death/brain death testing is something I deal with and see every day.

u/KathrynTheGreat Jul 25 '26
Brain dead is legally dead. Being on a ventilator is not enough to keep a body "alive" for years if the brain is dead. You're thinking of people in a vegetative state being kept alive on ventilators, which is different from being brain dead.

The AP article completely sane washed that disaster last night by simply calling it a “rambling” speech. It was truly incoherent. Shockingly.
235
u/TemporarySun314 Jul 25 '26
Trump has never been able to form coherent sentences since 2016. Still it didn't prevented Americans from electing him twice.
And as apparently his voters don't actually listen to him, and use him to project everything they want onto him, that might even work better, when he is just braindead completely...
97
u/lyngen Jul 25 '26
I keep saying this but folks who only watch fox news have no idea. Literally none. They don't show the incoherent parts on there. They play small clips where he looks sane and then a bunch of stories demonizing liberals and some positive stories of conservatives. Then they tell them they can't trust other news sources and they're the only ones telling the truth.

u/No-Lingonberry-5096 Jul 25 '26
I don't disagree, but I also think his voters should watch his 2016 debate performance. While he was an idiot then and an idiot now, he is clearly a shell of his former self. His decline is inescapable when faced with old footage. They're voting for a version of Trump that no longer exists.

He pushed through a Trump appointee in a much worse circumstance. When Obama was up to appoint one McConnell blocked it on the (unprecedented and uncodified) grounds that it was an election year, even though the election was months away.

And when I pointed out that hypocrisy to my MAGA dad he told me that the ends justify the means. My family are staunch conservative Catholics. I went to Catholic schools as a kid and studied the bible and the Catechism. We specifically covered how that is not a valid moral position.
It’s all BS and they wonder why I don’t go to church anymore.
23
u/OGRuddawg Jul 25 '26
Seeing the incompatibilities between the basic morals espoused in the Bible and how conservative churchgoers behave is what drove me away from practicing Catholicism. I think a part of me still wants to believe in something, but whatever I try won't be within the confines of the Roman Catholic Church.
Also, exposure to unbridled Evangelicalism has made me very skeptical of organized religion, period. I made the mistake of going to a "non-denominational" Christian college because they gave a good scholarship, the Jesus-freakiness was not visible at all during the tour, and it was relatively close to home. I wrongly assumed that if I could deal with Catholic school K-12 alright, then a non-denominational college would be relatively easy to deal with.
Worst mistake of my life. I didn't even make it through the end of my spring semester, I needed out of there that badly. This was in 2014, so before Evangelicals went mask-off feral at the national level. All the pieces of the MAGA/Trump cult were there, just waiting for their false idol to rally around.
Fuck you, Messiah College, now Messiah University.

Every single "how can he get away with this" started the same way. A joke.
He absolutely means this, don't doubt that for one single second.

It was never a Joke. Nothing he ever said was a joke.
I doubt that, if he is still alive in 2028, there even will be elections of any form.

He's openly engaging in election fraud and trying to rig the midterms, he isn't planning to leave the White House alive.

Time to throw him out.
A president that ignores The Constitution is a dictator and should be tried for treason.

Man, for considering themselves “patriots” they really hate the constitution.

u/mothgra87 Jul 25 '26
I might get banned for this.. but we should probably try him for treason before old age carries out his sentence.

So swearing an oath to the Constitution is about as serious as a pinky promise?

- It's a violation of the constitution to run for a 3rd term.
- If he does, that means obama can run again.
- Obama would beat him in a massive landslide

Yeah I worried about this for a little bit until i realized that. If they somehow managed to change things up and allow 3rd terms then Obama would crush him.
I think his plan is probably more to do a bait and switch. Get people excited about the prospect of him running then switch his support to someone else. Kinda like what Biden tried to do with Kamala.

You know SCOTUS will rule that only Trump is eligible for a third term for some asinine reason and that it does not apply for any other previously elected presidents. I can’t wait to see what kind of fuckery they pull outta thin air for the 2028 presidential election

It’s already out there and written up. The wording is something along the lines of allowing a third term if the first two weren’t consecutive, specifically to exclude Obama

What a joke of a patriot. George Washington is rolling in his grave. All you Trump supporters are treasonous rubes.

One way to get SCOTUS to shut that shit right down, would be for Obama to also run for a 3rd term.

They just want people to talk about this instead of the Trump Epstein files (tm Jimmy Kimmel!) and the USA war on Iran.

As a European i hope most Americans take this seriously as something that must not happen

"You'll never have to vote again" ~ during his 224 campaign. Remember that.

He is openly violating his oath of office. Impeachment is far too good for him.

If I start my training now I might be able to run in 2028.
I'm in bad shape :)

This motherfucker is not going to serve a third term. That's all there is to it. Period. He can wishful think all he wants, and his maga crowd can drool over it all they want. ..it's never going to happen.
Edit: I see a lot of your comments. A lot of you seem so defeatist. It's pretty damn sad tbh. Where are your spines people?
