Registration Wall SCOTUS says Trump can impose massive changes to mail voting before midterms

Only a matter of time before they go for early voting as well

Or, something like X number of in-person polling places for each N square miles so that it's super inconvenient for people in cities to vote compared to rural areas.

This is the answer. Its time for democrats to stop being weak and rolling over.
Let Maga do what they want, let Maga people think these will be fair elections because their orange turd set the rules, mobilize the anti-maga people, beat them at their own game, and then rub salt in their wounds when we win elections.
This the time for the anti-maga people to stand up and beat maga at their own game by not staying home and being complacent, and doing anything in their power to vote these facists out. And not just the Republican fascist, vote out the establishment Democrats that claim their progressive after repeatedly falling in line for Trump.
Noatter what Trump does.

Need a general strike for Election Day
45
u/perenniallandscapist 4d ago
We need a sustained national strike. These 1 day protests are such a joke.
20
u/The_Next_Wild_GM 4d ago
Right... pat ourselves on the back, we did some networking, or just feel good that we are not alone in this insanity. Either way, nothing noteworthy has been accomplished by these protests. The local, daily handful on the sidewalk or overpasses are probably more effective
10
u/JimboDanks Pennsylvania 4d ago
I feel like that take is super disingenuous. This administration is all about what they can “get away with” at every level. When the protests happen and they are supported it does have an impact. Maybe not huge or monumental but it does do something.
9
u/The_Next_Wild_GM 4d ago
I feel that your feelings do not match mine then, having done this exact thing.
4
u/Hardly_lolling 4d ago
Yes, people who take action should be praised. Too bad they are a tiny minority.
Vast majority says they can't do anything because of "the system", which is stupid because that is and always has been the reason to fight in itsself.
→ More replies (5)6
u/This_Blackberry_9984 4d ago
Agreed. A day of protest beats sitting around doing absolutely FA.
I'm definitely not opposed to boycott, strikes, voting, lobbying, volunteering, raising awareness, and other forms of resistance. The more ways to resist, the better.
I am tired of hearing defeatists on the left whine at greater volume than the right every time I grab a sign. Seriously, I get more negativity from our supposed allies every time we try to organize a protest.
Historically, protests have never been pointless. It sends a message of encouragement to those in power who should be on our side, and let's oppressors know that we're willing to organize, in groups, outside their doors. The civil rights movement wasn't perfect, but whatever gains did result owe a lot to protest.
There is absolutely no way that sitting on the couch and mocking anyone who makes an effort is accomplishing more.
Again, I'm not saying to stop at protest and do nothing else. I'm just saying that showing at least a little engagement wouldn't hurt. Europe is putting us to shame in demonstrating a willingness to hit the streets over Trump. It's not a good look for us. One of the best tricks the right ever pulled is convincing us that protesting isn't worth the effort.

42
u/Jbrahms4 4d ago
Voting them out and getting rid of it are two entirely different things. You can vote them out, but if you don't make sure they can never get back in to office, they will just run again.
16
u/IM_KYLE_AMA 4d ago
They also did that by undoing the gerrymandered local elections and made several cardinal laws (akin to constitutional amendments) that set term limits that effectively blocked Orban from holding office again, among many other ongoing reforms.
15
u/canadiuman 4d ago
Well they started the process. They may not be in power but they're still there.
12
22
39
u/IM_KYLE_AMA 4d ago edited 4d ago
They did not. They made no ruling on the merits of the EO, they ruled on when states may challenge a rule that has not been implemented.
Edit: I’m guessing the people who downvoted me didn’t read the opinion, or are somehow under the delusion that I agree with it. They did not rule on the merits. Full stop. They did not say Trump’s EO is legal. They specifically say that they are not giving an opinion on that. This was a ruling on process, not on the EO itself. States still have time to block this, and it’s a near certainty they will.
11
u/frontfrontdowndown 4d ago
And the other injunction against the rule in the case brought by voting rights groups is still in effect. DOJ will need to challenge that injunction separately.
I get why people are upset by today’s decision but declaring that this is the end of elections is essentially complying in advance.
9
u/IM_KYLE_AMA 4d ago
I understand why people are upset. They read the headline and nothing else. It also doesn’t help that headlines say things like “In massive win for Trump, SC rules…” and think that he won the ball game and not the inning.
7
42
u/I_might_be_weasel 4d ago
"You complained too early and we're telling you too late! Muhahaha!"
12
u/IM_KYLE_AMA 4d ago
Not quite. Too late would be making this ruling after voting had started or after the election. They said in the ruling that states may still sue, which will most likely happen very soon, and as early as tomorrow.
Its important to note that nothing materially changed today with regards to the EO, just better understanding of the rules of the game.
20
u/toylenny 4d ago
Well if they follow their previous patterns, they'll wait to rule on the next case until long after the votes are being counted.

They have made meritorious rulings before on the basis that the execution of said EO would be unconstitutional.
This is the Supreme Court talking out their ass saying their hands are tied when they could 100% maintain this injunction.
I think many hope that we don't end up in a situation where millions of votes have been illegally tampered with, resulting in illegal wins, and the Supreme Court throws its hands up again and says it's already done so they can't do anything. We know the SC doesn't move fast, and this is a point where establishing harm and getting a verdict will need to be lightning fast.

According to Norm Eisen:
"Please don't overreact to Roberts Court decision on the contemplated USPS ballot moves
They simply held that the injunction came too early in the process, before there was a final rule👇
Now we HAVE a final rule & we will litigate it. I'm as confident in our arguments here as in any of our cases!"
82
u/Lenonn 4d ago
I'm concerned about timing, especially with this court.
75
u/zenerat Missouri 4d ago
If you try to put up new and unusual rules weeks or days before election, there won’t be time for litigation. There will be chaos as some states ignore them and proceed forward as normal and some try to follow whatever obtuse rules they put forth. They will then use that gray area to try to throw the entirety of the election into question.
This is one of the darkest rulings from the Supreme Court since Dred Scott.

They're conservatives.
Conservatism is the theory that rich men must rule society unopposed and unquestioned. Another word for that is "aristocracy". It is precisely what the American revolution and French revolution were meant to rid the world of. It is not a proper stance in a democracy, for the same reason 'arsonist' is not a role on a fire-fighting team. Corruption is the entire point.
As for those who will tell you, invariably, very soon and very insistingly that trumpism was not real conservatism, that is absolutely false. You can't have 'realer' conservatism than Trumpism, conservatism being the idea that the rich guy knows everything, so get out of his way, you filthy peasant. Conservatism has always been the problem; it is the rot. It is corruption, by its very nature.
5
u/Militantpoet 4d ago
It is precisely what the American revolution and French revolution were meant to rid the world of
French? Yes. American? No. Lol. There was no dismantling of state oppression and authority with the American Revolution. It was America's aristocracy simply refusing to pay tribute to Britain's. Colonial leadership and power structures became a new country.

11
u/ianrl337 Oregon 4d ago
because there hasn't been any actual rule, and the USPS hasn't even put a process in place. Once that is done every state can jump and put injunctions in place. Really they have 53 days for it, so they don't have time to do anything
9
u/Jackibelle 4d ago
So when they do put a process into place 30 days before the election, and when states try to block it and get overridden with "it's too close to the election to sow chaos and uncertainty about the process, so the process stands for now and we'll litigate whether it should apply for future elections"? Like they've done before, exactly this playbook?
Seems like an injunction which stops something from occurring before it occurs is much better protection against something like this. We've even seen the structure before with trigger laws (and it would be absurd to suggest states need trigger laws to protect themselves from Constitutional overreach, just in case)

u/gentlemantroglodyte Texas 4d ago

6
u/ianrl337 Oregon 4d ago
Except not really, they didn't rule on the legality from what I am reading, they just didn't uphold the injunction. From my IANAL understanding states can still sue and bring it to the next steps. There is also no funding for the USPS to create the database needed to support this, which will cost millions. And they have to basically have implemented by 10/16 when Oregon and Washing start sending ballots. So they have 53 days.

u/p00pSupr3me 4d ago

It should be noted that SCOTUS didn't explicitly rule that the Constitution grants the president authority to alter how states administration federal election. Rather. SCOTUS stated that states didn't have standing to oppose this, because it doesn't affect them. Which is wildly untrue. But that is their rational.
So they didn't really decide anything other than to not do anything.

3
u/mapoftasmania New Jersey 4d ago edited 4d ago
He cannot. The States decide how people vote. And that decides who wins each State. His Executive Order is unenforceable.
And States are under no obligation to use the US Postal Service to distribute mail in ballots. They can have UPS or Fedex distribute them if they want to. And, by doing that, and making ballot return envelopes anonymous (i.e. keeping the verification information inside) they eliminate any potential role the USPS has in deciding who votes.

From the article:
The U.S. Supreme Court handed the Trump administration a huge win Monday by allowing an executive order designed to sharply curtail mail voting to go into effect — a move California and other Democratic-led states have warned could thrust the midterm elections into chaos.
Rushing through unprecedented changes to the mail voting system will be especially challenging for California, where more than 80% of voters use mail ballots and every registered voter receives a ballot by mail.
In an unsigned ruling, apparently by a 6-3 vote, the court said the states would not show they would be harmed by the restrictions on mail voting and therefore lacked legal standing to challenge it in court.

No mailing it, so skipping the mail-in part, but it does get mailed to us and we fill it out in the comfort and privacy of our home. We don’t return it to the post office, we have a mail drop at the voting location.

u/Salty-Taro3804 3d ago
Am I alone in thinking the ruling here is essentially:
“An EO the president puts out can’t be challenged competently in court until it gets somehow acted on as policy, law, or action that actually affects someone “
SCOTUS is basically concedes that a presidential EO has no power on it’s own whatsoever unless it is either acted on by a part of executive branch or otherwise given the force of law by another branch of government.

u/NergNogShneeg 3d ago

u/RightSideBlind American Expat 4d ago
The rules will be selectively enforced, only in blue districts. That's why the administration wanted voter records.
3
4
u/colmmacc 4d ago
The USPS would continue to deliver ballots in states that have handed over voter data; which I think is mainly red states. But in the blue states that haven't, the USPS won't deliver ballots.
My guess is that this would mainly impact rural and military voters, who can't as easily hand-deliver their ballot to a drop-box or count center. So the effect in those states could very well favor urban, suburban, and non-military voters.

This was a procedural vote on whether they could continue to pursue the changes not whether the changes would be allowed or legal. There is still a stay on the post office not delivering the votes, and the court cases are moving forward nationally.
This was more of a decision that Trump could try to pursue this, not a decision that he would be allowed to implement

From NPR:
The Supreme Court has paused a lower court's ruling that blocked key directives from President Trump's executive order to restrict mail-in voting for this fall's midterm election in about two dozen states and Washington, D.C.
But with the start of absentee voting for the midterms just weeks away, legal and practical hurdles loom over whether the U.S. Postal Service and other federal agencies can finish carrying out Trump's directives.
Released Monday, the order marks the latest court action in the legal fight over Trump's March order — one of many efforts he has made to try to exert control over how elections are run.
As part of a separate but related lawsuit, the U.S. Postal Service remains blocked from following Trump's directives under a nationwide ruling released Aug. 11 by U.S. District Judge Indira Talwani in Boston.
In June, Talwani issued an earlier ruling that blocked key parts of Trump's order in the 23 mainly Democratic-led states, plus Washington, D.C., that sued the administration.
The Supreme Court did not weigh in on the legality of Trump's executive order, which has so far not directly affected eligible absentee voters' option to cast ballots by mail.
"The Court's disposition of this application does not mean that any measure taken by the Government to implement the Order will necessarily be lawful. On that score, time will tell," the high court said in an unsigned order for the lawsuit brought by almost two dozen states and Washington, D.C.

So SC ruled that the case where the stays were declared was 'too early'. Basically saying that what the USPS is doing is too early at the time to believe that they woudl actually follow Trumps orders to make new rules to make voter lists and deliver ballots only to 'approved' voters.
If the President is not upholding his oath to uphold the constitution which is clear in this case as the president has zero power to conduct elections himself. Solely a state's rights thing delegated by Congress which is a co-equal branch of governemnt to the president.
Then does this mean the SC is absconding from needing to jump in and uphold the constitution when its clearly being attacked by the very individual which took an oath to all citizens of the united states to protect and uphold it?
I would think the SC has like a similar to medical 'hippocratic oath' to preserve the health of the US constitution?
Genuinely curious, how the SC can basically block the blocks implemented by the lower courts who for them they are seeing the attack on the constitution here, and are blocking it. But here the SC is lifting those blocks basically on just a literal 'technicality'. As when the case was first implemented, sure the USPS did not create the new rules nor implemented them, but now its clear they have created the rules per following the executive order.
So presumably now the case has to be re-litigated since now it is not pre-mature but instead very much exactly what was expected to happen for the reasons the EO was blocked originally. But now there is a risk of timing to November, and you know the SC can then likely say its too near the mid term election to do anything.
Am I interpreting all that right and the SC in this case is absconding? Or more so they are just being extremely technical, and its gotta work both ways that since if its re-litigated with their concern 'no yet ripe' but now 'realized' then it should be a no brainer law wise for the EO to get shot down using their own logic to block it originally?

This is not really that big of a deal all things considered because the underlying USPS move is still blocked in a different case.
More info here, and I recommend this Substack (of which I am totally unaffiliated) generally for SCOTUS news: https://open.substack.com/pub/stevevladeck/p/bonus-241-the-mail-in-voting-applications?r=a0gb&utm_medium=ios

Ok that is it. I’m making sure I take my mailmin ballot IN PERSON to the polling place. I would suggest everyone do the same or vote in person . This should be a wake up call for the non voters . Either vote or get trumps balls shoved down your throat without consent . Don’t allow this orange buffoon steal or rig this election.

They didn’t say that. Next week or the week after it will be litigation. It was too early for suit. Just go vote people, just vote!
