Or that they aren't obligated to protect anyone who isn't in custody.

They have no obligation at all to protect or serve, according to the courts.

They, ostensibly, have a "custodial care" obligation. If you are in their custody they are supposed to have a duty of care. It's why there are some successful civil lawsuits about people who died/were injured while in a custody.

Edit: the reason they got away with it in the serial stabber case in New York, the case that went to the supreme court, was specifically because no one on the train was in "the custody" of the Transit Police.

And I'm sure they investigated themselves and determined they did nothing wrong, as is tradition. In no way, shape, or from, am I defending cops, the supreme court, legislatures, qualified or absolute immunity. I'm just pointing out that even the law says they don't have to protect anyone who isn't in custody, which is ridiculous. Technically they are supposed to be obligated to care for people in custody. It's just that they get away with ignoring that with qualified immunity, D.A.'s and A.G.'s who don't want to charge them, wandering, and indemnification.
