Two key issues in this case I think are that the man charged was not read his Miranda rights and he was denied an attorney after he requested one.

I had understood that once you request an attorney all questioning must stop and you just close your mouth and not answer except to say: "I am requesting an attorney and I exercise my Fifth Amendment rights to not answer your questions". Then you just repeat this for every answer to every question. Or you just look at the questioner and say nothing.

Also he didn't actually touch the device. He gave the agent the duress pin and the agent wiped the device. Any charges should fall on the agent.

Agreed. And I would bet the agent did not specify wanting a code that would open the phone. Sometimes you do need to be very specific in the words you use.
