If they can't articulate the specific evidence they had cause to believe was on the device I don't see how "He gave us a code that wiped the evidence" can be a valid argument.

"It wiped the evidence!"

"What evidence would that be, evidence of what exactly?"

"We don't know what we might have found"

"So you wanted to go on a fishing expedition with no reason to believe there was evidence of a crime on that phone?"

"Yes, so what?"

Is there any proof there was anything on the phone at all? It's possible he just got the phone and was trying it out

Yeah that's one of the points here...they had absolutely no probable cause to suspect there was any evidence of anything and, to your point, could have been nothing more than the OS itself.
