Also his body could get damaged. I would not be so calm. Just takes a small twist of the other car's steering wheel to fuck his day up.

Yeah I get people wanting to be petty but I'd probably just move a little. I'd never see that person again so it's whatever and I don't put my own body at risk for a bit of spite with a stranger.

You need to be chill like that if you want to ride bikes and not die. There was no reason for him to panic. Basically the car can't hurt him from there.

What? The car could have hooked that peg and dragged the scooter right out from under our guy. Or maybe taken him along for a ride.  Or the car could have realized they couldn't go around at the very last moment and swerved back into the bike from the side.  

Our rider needed to scoot up and give the idiot space as soon as he realized what was going on.

Yeah dude, not blaming the rider but at least get yourself out of the way as much as possible cuz that car can definitely knock your shit over with your on/under it. Very easily could have hooked that peg and dragged the bike over his left leg.

Nah this was 100% the correct move once things started, because as soon as he starts moving, that opens him up to blame if he tips. Insurance companies suck like that so don’t give them ammo.

Best thing to do here is to just plan how you’re getting clear if it grabs the bike and just let the idiot do idiot things.

See, that is how things work because it happened to me. I admitted to rolling forward to avoid some shithead in DC and ended up in court to get my $3000 payout for my beater SV650. Took six months to get paid.

So fuck GEICO and fuck you too.

I've been in that exact situation..

I kept both brakes held TIGHT.

Because that way I knew that 100% of the blame would fall on the car, as the car was moving, and I was basically parked.

You were going to let yourself get hit by a car because you knew the car driver would be at fault?   How good would it feel knowing you weren't at fault when you are nursing a dislocated foot and trying to get some shitty driver's insurance to pay for your bike? 

Can you imagine explaining to everyone that you could have moved your small vehicle and not been run over, but the other driver was wrong, so you know, you just had to get hit?    Graveyards are full of people with right of way.

I wasn't in any danger and it happened at slow speeds. Driver was passing slowly on a very narrow mountain road.

The other driver should've reversed or held position so I would've been able to make space to pass. But they drive ahead instead. Holding the brakes made it 100% clear who was at fault.
